April 26, 2023 is the 23rd World Intellectual Property Day. In order to promote GT members' understanding of intellectual property (IP) and raise their awareness of respecting knowledge, advocating science, and protecting IP, GTEC organized a series of exciting activities for the GTIIT IP Day.

Prof. Moris Eisen, PVCAA of GTIIT, gave a welcoming opening speech for the event online. He pointed out that universities are a main source of innovation, and the protection of the intellectual property rights is important for the protection of the innovations. GTIIT's cutting-edge scientific research generates valuable IP that will create numerous opportunities to work with industries and hopefully to apply the new technologies to the society. This is a great opportunity to encourage faculty and students to innovate by thinking "out of the box", which will eventually strengthen and improve GTIIT-industry relationships.

Michael Lv, Director of the GTEC, extended a warm welcome to participating government guests, teachers and students. GTIIT has attached great importance to innovation and entrepreneurship based on IP, and established GTEC in 2021, which is in charge of IP protection and commercialization, industrial cooperation, and guidance for innovation and entrepreneurship of GT members.

In the evening IP lecture, GTEC invited Li Changqing, a patent examiner from Shantou Intellectual Property Protection Center, to give a detailed introduction to IP protection.


In the Q&A session, GTEC designed an open discussion on "whether the creations generated by AIGC can be registered for intellectual property protection". Huang, an MCS student, shared his thoughts on this topic from the perspectives of logic, rationality and law. MSE student Wang, elaborated on her own views based on his experience.

At the end of the lecture, the guests from the Municipal Law Popularization Office, Intellectual Property Administration and the Intellectual Property Protection Center drew prizes for the lucky audience.  All participants together took a group photo as a souvenir, which successfully concluded the activities of Intellectual Property Protection Day.

GTIIT Intellectual Property common FAQ Appendix:


1. How should we protect the content/technology from our paper if we want to publish the paper?

A: In this case, it is recommended to apply patent first and publish paper later, because the law protection of the content/technology begins when the patent application be submitted.

 

2. If I only have a preliminary idea, to what extent it is able to apply for intellectual property protection?

A:It depends. If the application is a chemical formulation, we require clear experimental data to prove its feasibility.

If the application content is the assembly of some kind of mechanical equipment, maybe just the characteristics of this assembly is needed.

 

3. If I invent something A and register it as a patent in China, how should I protect my rights if someone applies A as a patent in other countries?

A: Others cannot apply your protected patent, each of our submitted patent's information will be sent to the Patent Cooperation Treaty (PCT) for filing.

If you (the patent official right owner),want to do international patent applications, we can submit through the PCT, which is valid in over 150 countries of the Convention, or do specific country applications. Because patent protection is territorial, your technology will only be considered for grant if it is filed locally.

 

 

4. In horizontal cooperation, does China have legal provisions for Technology Development?

Civil Code of the People’s Republic of China Article 859: Where an invention is accomplished through commissioned development, the right to apply for patent thereof belongs to the researcher-developer, unless otherwise provided by law or agreed by the parties. Where the researcher-developer has obtained the patent right, the client may exploit the patent in accordance with law.

 

5. In horizontal cooperation, does China have legal provisions for the ownership of inventions?

A: Rules for the implementation of the Patent Law of PRC Article 11:

An inventor is a person who makes a creative contribution to the substantive features of an invention-creation.

In the process of completing an invention-creation, a person who only responsible for organizing work, offer facilities for using material conditions, or performing other auxiliary work shall not be an inventor.

 

6. How do I choose a patent agent when applying for a patent?

A: GTEC will provide a list of patent agents we had cooperated with, including company strength, areas of expertise, serviced whom in our university, price for reference, etc.

Applicant can select agents and interview them according to the characteristics of the technology you plan to apply, and finally select the partner.

Applicants can also recommend agency suppliers with good cooperation foundation and cooperate with them after passing the assessment of the school.
